Terms and Conditions of Use – End User (Moovflex)
1. Introduction and Purpose
1.1. These Terms and Conditions (“T&C”) govern access to and use of the Moovflex platform, owned by Traveller Street, Lda., VAT Number 517831490, Rua Pedro Nunes – IPN Coimbra, Edíficio C, 3030-199 Coimbra, a company based in Portugal, hereinafter referred to as “Moovflex”.
1.2. Moovflex provides a digital intermediation platform that enables the User to book and pay for sports and well-being activities offered by independent professionals duly registered in the app (“Professionals”).
1.3. By accessing, registering or using the services, the User declares that they have read, understood and accept these T&C, as well as the applicable Privacy Policy and Cookies Policy.
2. Eligibility and Account
2.1. Only persons aged 18 or over may create an account. Minors may do so only with the authorisation and under the responsibility of their legal representative.
2.2. The User warrants that the data provided are true, complete and up to date, and is responsible for their accuracy.
2.3. Creating multiple accounts by the same User is prohibited and may lead to suspension/deletion of the accounts.
3. Nature of the Platform and Role of Professionals
3.1. Moovflex acts solely as an intermediary, providing technology that connects Users and Professionals.
3.2. Moovflex does not directly provide sports or well-being services and does not guarantee the quality, safety, lawfulness or suitability of the Professionals’ services.
3.3. Verification of qualifications, certifications or insurance of the Professionals is the exclusive responsibility of the latter.
4. Express Acceptance of the T&C
4.1. Access to certain features may require the User’s express acceptance of these T&C (e.g., ticking a “I have read and accept” box, clicking a confirmation button or an equivalent technical action).
4.2. Moovflex may store the electronic record of such acceptance as evidence of consent.
5. Bookings, Cancellations and Refunds
5.1. Bookings are made on the Moovflex platform and paid in full at the time of booking.
5.2. User cancellation conditions:
- Up to 72 hours before the activity: full refund;
- Between 72 hours and 24 hours before: 50% refund;
- Less than 24 hours before or no-show: no refund.
5.3. Refunds are processed via vouchers for use on the platform in a future purchase..
5.4. Unjustified absence is treated as a cancellation with less than 24 hours’ notice, with no right to a refund.
5.5. All prices displayed on the platform are inclusive of Value Added Tax (VAT) and any applicable transaction or payment processing fees.
6. User Conduct
6.1. The User undertakes to: (i) use the platform solely for lawful purposes; (ii) not make abusive, fictitious or fraudulent bookings; (iii) comply with schedules, rules and instructions set by the Professionals; and (iv) not impair the operation of the platform or the reputation of Moovflex.
6.2. Breach may result in immediate suspension or deletion of the account, without prejudice to civil/criminal liability.
7. Risk Notice and Limitation of Liability
7.1. The User acknowledges that engaging in physical activities involves inherent risks, including accidents or injuries.
7.2. The User declares that they are in adequate physical condition, assuming full responsibility for their participation.
7.3. Moovflex, its directors, employees or partners shall not be liable for damages arising from the use of the platform or participation in activities booked through it.
7.4. Claims or requests for compensation related to the activity must be addressed directly to the responsible Professional.
8. Intellectual and Industrial Property
8.1. All platform content (software, texts, images, graphics, logos, trademarks, copyrights, databases, videos and sounds) is the property of Moovflex or of third parties who have authorised its use/licensing.
8.2. It is prohibited to copy, reproduce, modify, distribute, publish, license, sell or create derivative works from the content without Moovflex’s prior written authorisation.
9. Amendment, Suspension and Interruption of Services
9.1. Moovflex may, at any time and without prior notice, modify or update services and content, restrict access to features, or suspend/terminate the operation of the platform temporarily or permanently.
9.2. Moovflex is not responsible for unavailability, technical failures or access interruptions.
10. Third-Party Links
10.1. The platform may contain links to third-party websites/applications, for which Moovflex is not responsible regarding content, policies or practices.
10.2. Users are advised to read the terms and policies of such third parties before using them.
11. Communications and Support
11.1. Operational and informational communications may be made by e-mail hello@moovflex.com, mobile phone +351 96 322 65 27, platform notifications or other appropriate means.
11.2. Requests for clarification, support or complaints must be submitted through the contact channels made available on the platform.
12. Data Protection and Cookies
12.1. The processing of personal data in the context of the platform’s use is governed by the Privacy Policy, and the use of cookies by the Cookies Policy, both available on the platform.
12.2. The User must read these policies carefully before using the services.
13. Changes to the T&C
13.1. Moovflex may amend these T&C for legal, technical or commercial reasons.
13.2. Amendments take effect from their publication on the platform; continued use of the services after such publication constitutes acceptance of the new T&C.
14. Governing Law and Jurisdiction
14.1. These T&C are exclusively governed by Portuguese law.
14.2. For disputes arising from the interpretation or performance of these T&C, the courts of the judicial district of Lisbon shall have jurisdiction, with waiver of any other.
15. Payment Partner
15.1. Payments on the Moovflex platform are processed by Easypay, a payment institution authorised and supervised by Banco de Portugal.
15.2. Accepted payment methods include Visa and Mastercard.
15.3. Moovflex does not store card details; all payment data is handled securely by Easypay in compliance with PCI-DSS standards.
